Terms of Service for Datatech ehf.'s Data Recovery Service

(Definition of the term "data recovery": the recovery of electronic data from faulty electronic equipment such as hard drives, SSD drives, NVMe drives, USB flash drives, RAID arrays, camera memory cards, smartphones, laptops and so on.) *Datatech ehf., kt. 42015-0240, hereinafter "Datatech"

  1. Datatech carries out fault diagnosis on equipment owned by the customer and charges an hourly rate for this, generally one hour according to the price list, but only where the customer does not accept a data recovery quotation, withdraws, or fails to respond to a quotation sent to them by email following fault diagnosis of equipment they have brought to Datatech. This charge is non-refundable under all circumstances and serves to cover Datatech's cost of carrying out the fault diagnosis. An hourly charge is also levied where a customer brings in an item for data recovery from which no data can be recovered by any means, or where there is no data on the equipment to recover — for example, where a completely empty hard drive or camera memory card is submitted.
  2. When fault diagnosis is carried out, it is often necessary to break open the housings in which hard drives are supplied by the manufacturer; these cannot be reused and are therefore disposed of. The customer agrees to this by accepting these terms when submitting a service request. It is also possible that such drives fall outside the manufacturer's warranty as a result of this procedure; the customer acknowledges this, and Datatech accepts no liability for damages on that account.
  3. Datatech charges an additional hourly rate, generally 0.5–1 hour, for removing hard drives or other storage media from laptops, desktop computers or servers. Where a drive must be removed from an Apple iMac that is under the manufacturer's warranty, this must be done at an authorised Apple service centre, and only the drive should be brought to us.
  4. Datatech offers an express service at an additional 9,900 ISK including VAT, and an emergency service at an additional 19,900 ISK including VAT. The express service means only that work on the project begins the next working day, and the emergency service means only that work begins the same day if the item is brought in before midday. The express and emergency services do not include any data recovery, nor any promise that the project will be ready the next working day or immediately — only that work on it begins sooner. If standard priority is selected, the project joins the queue and work generally begins within the next 5 working days.
  5. Datatech undertakes "data recovery" (that is, the recovery of electronic data from faulty electronic equipment) after carrying out "fault diagnosis" on the customer's equipment and after the customer has accepted a quotation for "data recovery" in writing or by email. Data recovery begins only after the customer has accepted the quotation, after which the quotation is fully binding on the customer.
  6. Datatech cannot, does not and will never under any circumstances promise a particular result. We do, however, use recognised data recovery methods and the technology at our disposal, which offer the best possible prospect of success in each individual project of recovering the customer's electronic data from the equipment or item they bring to the company for service on any given occasion.
  7. Datatech does not warrant that all, or any, data will be recovered from the customer's equipment or item, in any respect whatsoever.
  8. Datatech does not warrant that equipment or an item owned by the customer will not be damaged during the efforts of Datatech's staff to recover or copy electronic data from it, and Datatech accepts no financial or other liability on that account.
  9. Datatech bears no liability, financial or otherwise, in any respect for the customer's data or equipment, even while it is in the custody of the company and its staff.
  10. Datatech bears no liability for the customer's data under any circumstances.
  11. Datatech bears no liability for the nature of the data recovered, its condition, its lawfulness or its usefulness to the customer, provided that it is copied unaltered from the customer's equipment.
  12. Datatech reserves the right to withhold equipment or an item that the customer has brought to the company for service unless the invoice for the service has first been paid in full and demonstrably so.
  13. If the customer brings equipment, a device or an item to Datatech or its staff and partners for data recovery or other services and does not collect the equipment, device or item within 90 days of the project being handed over to Datatech or Datatech's partner, then Datatech, its staff and its partners are entitled to dispose of the equipment permanently. The customer shall have no claim against Datatech in that regard thereafter, and Datatech bears no financial or other liability of any kind towards the customer.
  14. Once a project is ready and the customer has been sent a file list and has then received their data, they have only 7 days in which to raise an objection if anything is missing or is not in order. After that period the project is deemed complete, all data copies are permanently deleted, and the matter cannot be reopened.
  15. Datatech requests payment of the total outstanding balance as soon as the project is ready for delivery and the customer's data has been recovered and demonstrated by sending a file list to the customer. If payment is not made within a reasonable time, the claim will be forwarded to Inkasso.is for debt collection. The customer provides an email address and telephone number (contact details) for the purposes of the transaction and agrees that these contact details may be passed to the debt collector should collection proceedings arise. The customer further agrees that the contact details may generally be used to communicate with them in connection with collection, including through electronic collection processes.
  16. Comments regarding invoices: Any objections to invoices issued must be made without delay and no later than the due date of the invoice; otherwise the invoice is deemed accepted.
  17. Owing to potential conflicts of interest, Datatech cannot accept projects from individuals or businesses that are under investigation by the Police.
  18. Retention of title: In accordance with Article 42 of Act No. 75/1997, Datatech reserves title to the goods sold until the purchase price has been paid in full, and reserves the right to repossess the goods sold or to dispose of them by compulsory sale pursuant to point 4 of Article 38 of the same Act. The buyer has acquainted themselves with this contractual provision and accepts Datatech's retention-of-title reservation upon receipt of the goods sold.
  19. A quotation sent to the customer by email is confidential between Datatech and the customer, and it may not be shared in any public forum, such as social media, or sent to unauthorised parties.
  20. If the data cannot be recovered as planned but some of it is recovered, the customer is offered the data that was recovered according to the file list, in which case a 10% discount is applied to the total quoted price.
  21. Datatech is not responsible for postal deliveries, for example with Iceland Post. If an item is lost or damaged in the post, this is solely the responsibility of the carrier.
  22. If a data recovery quotation is not accepted and the customer wishes to have their equipment or item returned, it will be sent via Iceland Post to the nearest post box at the owner's expense. Items cannot be returned to Datatech's receiving partners (such as Pixlar, who only handle the receipt of projects for Datatech). We return projects free of charge via Iceland Post to customers who accept a data recovery quotation.

Data protection, confidentiality and non-disclosure

  • The customer consents to Datatech and its staff processing the personal data relating to them and temporarily copying their personal computer data onto the company's secure hardware while data recovery is carried out on the customer's equipment. All copies of data transferred onto Datatech's hardware are permanently and securely deleted seven (7) days after the project is completed and the data has been delivered to the customer, and the customer has no right to request a further copy of the data after that time.
  • Under no circumstances will Datatech disclose to any third party information about its customers or their personal data.
  • All Datatech staff are bound by a duty of confidentiality towards the customer and are obliged to observe the strictest confidence regarding any data and matters that come to their knowledge in connection with the customer. This duty of confidentiality applies both outside and within the company and continues to apply even after a Datatech employee leaves the company's employment.
